Carers' Allowance and the Residence and Presence Tests.

In order to qualify for carers' allowance you need to be able to demonstrate that you have been ordinarily resident and present in Great Britain for more than 26 weeks in the past year.

You will not be awarded CA if you are subject to immigration control

The following exemptions allow you to be awarded CA even if you are subject to immigration control:

• You are the family member of a European Economic Area National;
• You or a member of your family with whom you are living are a national of Morocco, Algeria, Tunisia or Turkey and are lawfully working (or have lawfully worked) in Great Britain;
• You are a sponsored immigrant ie you are the subject of a mantenance undertaking whereby someone has agreed to be responsible for your maintenance and accommodation in the UK.

You are no longer subject to immigration control if you have been granted refugee status, humanitarian protection or discretionary leave.
